One of the Biggest Questions - How Do I Calculate Property Taxes in Michigan? 

Real Estate Taxes – State of Michigan 

Proposal A, which passed on March 15, 1994, placed a limit on the value used to compute property taxes. Prior to 1994, the State Equilized Value (SEV) was multiplied by the Millage rate to compute a tax bill. Today's tax bill is computed by multiplying Taxable Value (TV) times the millage rate. 

Property that has been continuously owned and no new construction since the passage of Proposal A will have a Taxable Value comprised of the 1994 SEV times the past seven years' Consumer Price Indexes. The Taxable Value must not exceed one-half of the Market Value and in most cases will be less than one-half of the Market Value, with this beneficial gap widening each year. 

The Taxable Value may not increase annually by more than 5% or by the Consumer Price Index, whichever is less. The two exceptions to this limitation are transfer of ownership and new construction. If a transfer of ownership occurred in the prior year, the current Taxable Value is equal to the current State Equalized Value. New construction, other than normal maintenance and repairs, will raise the Taxable Value by the contributory market value of the improvements. 

Also included in the passage of Proposal A was the creation of a Homestead Exemption. This exemption applies to those homeowners who own and occupy their home as their principle residence as of May 1. The homestead exemption removes the obligation of paying the school operating portion of the tax bill. 

So, for example, if you’re interested in purchasing a house or condo for $200,000 – the taxable value must not exceed 50% - so using a worse case scenario, let’s say the South Haven Assessor places the new taxable value at $100,000. You take $100,000 x the non-homestead millage of 59.1753 (per thousand) 

$100,000 x .0591753 = $5,917.53 total taxes for the year including both summer and winter tax bills. 

For a homestead property, your taxes could be: $100,000 x .0412153 = $4,121.53

Tax Considerations >New 1031 Exchange Rules

One of the most popular "tax deferring" strategies for real estate owners who are selling one property and acquiring another is the use of Section 1031 of the Internal Revenue Code. It is an effective way to defer paying income tax on capital gain generated by the sale of a property when you intend to reinvest the proceeds in a similar, "like-kind" property. Almost any kind of real property is considered "like-kind" with any other real property.

A recently enacted law closes what was considered a loophole in the Section 1031 rules. In some cases, owners of investment real estate have used the 1031 Exchange to swap their investment property for real estate that could be readily converted to an owner-occupied residential property. After the exchange, they made the property into their principal residence, lived in it for a couple of years, then sold it. Now the American Job Creation Act of 2004 has ruled that properties converted from a 1031 exchange property into a residence must be held and used as a principal residence for at least five years to qualify for the tax exemption. Otherwise, the basic tax-deferring benefits of 1031 exchanges remain the same.
